Halk arasında ‘arabuluculuk’ düzenlemesi olarak bilinen İş Mahkemeleri Kanunu Tasarısı Meclis’ten geçti. Resmi Gazete’de yayınlandıktan sonra yılbaşı itibarıyla yürürlüğe girmesi beklenen düzenlemeyi 15 milyon sigortalı çalışanın bilmesi gerekiyor. Yasa, ücret ve tazminat alacağı, işe iade gibi birçok konuda mahkemeden önce arabulucuya gitmeyi zorunlu hale getiriyor.

İş davalarının ortalama 454 günde sonuçlandığına dikkat çeken Mete, “Artık kıdem gibi anlaşmazlıklar 1 günde çözülecek” dedi. Maddi yetersizlik nedeniyle dava açamayanların para ödemeden haklarını arayabileceklerini belirten Mete, “Arabuluculuk işçiye de işverene de fayda sağlayacak” diye konuştu.

ÖDEME YAPILMAZSA İCRA YOLUYLA

Soru: Arabulucunun anlaştırdığı durumlarda işveren ödeme yapmazsa ne olacak?
Cevap: İşçi anlaşma tutanağı ile birlikte görevli mahkemeye giderek ‘icra edilebilirlik şerhi’ koydurup alacaklarını icra yoluyla tahsil edebilecek.

Soru: İşçi hangi durumda zorunlu arabulucuya gidecek?

Cevap: Adliyelerde arabuluculuk merkezleri kuruldu. İşçi, alacaklarıyla ilgili işverenin (karşı tarafın) bulunduğu yerleşim yerindeki veya işin yapıldığı yerdeki arabuluculuk merkezine başvuru yapacak. Sistem, Adalet Bakanlığı listesindeki bir arabulucuyu otomatik atıyor. İşçi ve işveren anlaşırsa istedikleri bir ismi seçebilecekler.

ANLAŞMA YOKSA MAHKEMEYE…

Soru: Anlaşmazlıklar kaç günde çözülecek?
Cevap: Arabulucu en fazla 4 hafta içinde anlaşmazlıkları sonuçlandıracak.

Soru: Taraflar anlaşamazsa ne olacak?
Cevap: Arabulucu sorunu çözemezse taraflar hakkını İş Mahkemesi’nde aramaya devam edebilecek. Yani dava yolu açık.

Soru: Arabulucuda alınan karar temyiz edilebilir mi?
Cevap: Anlaşma sağlanması halinde tarafların imzasının yer aldığı bir tutanak düzenlenecek. Mahkeme kararı niteliğinde olan bu karar temyiz edilemeyecek. Yani karar kesin olacak.

KATlLIM ZORUNLU

Soru: Arabuluculuk toplantısına katılmak zorunlu mu?
Cevap: Taraflar geçerli bir mazeret göstermeden ilk arabuluculuk toplantısına katılmazsa, tutanakta belirtilir. Toplantıya katılmayan taraf davada haklı çıksa dahi yargılama giderinin tamamından sorumlu tutulur.

Soru: Ücretlendirme nasıl olacak?
Cevap: Tazminatla ilgili arabuluculukta, her iki taraf tutarın yüzde 3’ü oranında ödeme yapacak. İşçinin zor durumunu gözeten patron gerekirse tüm masrafı ödeyebilecek. Anlaşma sağlanamaması halinde iki saatlik ücret Hazine’den karşılanacak.
